These Terms of Service ("Terms") govern your use of the Wildertag application ("the App"), developed and operated by whosfromthegreatstate ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 13 years of age to use Wildertag. By using the App, you represent and warrant that you meet this age requirement. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
To use the App, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

You retain ownership of the photos and images you capture using the App. By submitting images through the App, you grant us a limited, non-exclusive, royalty-free license to process, transmit, and store those images solely for the purpose of providing the App's species identification and journal features.
You represent that you have the right to capture and submit any images you upload and that doing so does not infringe on any third party's rights.
Species identifications, descriptions, and related information provided by the App are generated by artificial intelligence (Google Gemini) and are for entertainment and educational purposes only. We do not guarantee the accuracy, completeness, or reliability of any AI-generated content. Do not rely on the App for decisions relating to safety, foraging, medical use, or the handling of wildlife.
Certain features of the App use your device's location services. When using the App outdoors:
We are not responsible for any injury, damage, or loss that occurs while using the App in the real world.
All rights, title, and interest in the App — including its design, code, graphics, gameplay mechanics, and branding — are owned by whosfromthegreatstate or its licensors. These Terms do not grant you any right to use our trademarks, logos, or other brand elements.
The App relies on third-party services including Google Gemini AI and Supabase. Your use of the App is also subject to the terms and policies of those providers. We are not responsible for the availability, performance, or practices of any third-party service.
The App is currently free to use with no in-app purchases. We reserve the right to introduce paid features or subscriptions in the future. Any such changes will be clearly communicated before charges apply.
We may suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to the App or its users. You may delete your account at any time by contacting us.
Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including sections on liability, indemnification, and intellectual property) will remain in effect.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WHOSFROMTHEGREATSTATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, REGARDLESS OF THE THEORY OF LIABILITY.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY US DOLLARS ($50), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless whosfromthegreatstate and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your use of the App, your violation of these Terms, or your infringement of any third party's rights.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
We may revise these Terms at any time by posting an updated version within the App or on this page. The revised Terms take effect on the date of posting. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
